Terms of Service
These Terms of Service (“Terms”) govern your access to and use of the Mr Mind website and any products you purchase from us. By using this site or buying a product, you agree to these Terms. If you do not agree, please do not use the site or purchase our products. Nothing in these Terms excludes, restricts or modifies any rights you have under the Australian Consumer Law.
1. About Us and These Terms
Mr Mind (“we”, “us”, “our”) is an Australian business supplying digital self-development products. These Terms form a binding agreement between you and us. We may update them from time to time; the version in force is the one published on this page at the time of your purchase.
2. Eligibility
You must be at least 18 years old, or have the consent of a parent or guardian, to purchase from us. By placing an order you confirm that the information you provide is accurate and that you are authorised to use the payment method supplied.
3. Our Products
Our products are digital resources — such as downloadable guides, systems and worksheets — delivered electronically. They are provided for personal, educational and self-development use only. We describe our products as accurately as we can, but results depend on your own effort and circumstances, and we do not guarantee any specific outcome.
4. Not Medical or Professional Advice
Mr Mind products are for general informational and self-improvement purposes and are not medical, psychological, financial or other professional advice. They are not a substitute for care from a qualified health professional. If you are experiencing mental-health difficulties or a medical condition, please consult an appropriate professional. If you are in crisis in Australia, contact Lifeline on 13 11 14 or call 000 in an emergency.
5. Pricing and Payment
All prices are listed in Australian Dollars (AUD) and, where applicable, include GST. Payment is processed at checkout by our third-party payment providers. We take reasonable steps to ensure prices are accurate but reserve the right to correct errors and to change prices before you place an order. You must complete payment in full before your product is delivered.
6. Delivery and Access
Because our products are digital, they are delivered electronically — usually via an immediate download link or email after your purchase is confirmed. It is your responsibility to provide a valid email address and to download and save your product. If you have not received access, contact us at systems@mrmind.com and we will help.
7. Refunds and Your Consumer Rights
Our products come with guarantees that cannot be excluded under the Australian Consumer Law. If a product is faulty, not as described, or otherwise fails a consumer guarantee, you are entitled to a repair, replacement or refund, and to compensation for any other reasonably foreseeable loss or damage.
Because our products are digital and delivered immediately, we may not offer change-of-mind refunds once a product has been accessed or downloaded, except where required by law. If you believe there is a problem with your purchase, contact us at systems@mrmind.com and we will work with you to resolve it.
8. Intellectual Property and Licence
All content in our products and on this site — including text, designs, graphics and branding — is owned by us or our licensors and is protected by copyright and other laws. When you purchase a product, we grant you a personal, non-exclusive, non-transferable licence to use it for your own personal use.
You must not copy, resell, redistribute, publish, sublicense or share our products or content, or create derivative works from them, without our prior written permission.
9. Acceptable Use
You agree not to use our site or products in any way that is unlawful, infringes the rights of others, or interferes with the operation or security of the site. We may suspend or terminate your access if you breach these Terms.
10. Third-Party Links and Services
Our site may link to or rely on third-party websites and services (for example, payment and email providers). We are not responsible for the content or practices of those third parties, and your use of them is governed by their own terms and policies.
11. Disclaimers and Limitation of Liability
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that you have under the Australian Consumer Law or other laws that cannot be excluded.
Subject to those rights, our products and site are provided “as is”, and to the maximum extent permitted by law our liability for any claim arising from your use of them is limited, at our option, to re-supplying the relevant product or paying the cost of having it re-supplied. To the extent permitted by law, we are not liable for any indirect or consequential loss.
12. Privacy
We handle your personal information in accordance with our Privacy Policy, which forms part of these Terms.
13. Governing Law
These Terms are governed by the laws of Australia and the state or territory in which our business is based. You and we submit to the non-exclusive jurisdiction of the courts of that state or territory and of Australia.
